What we are looking for…

A mid-level real estate attorney focused on setting our real estate transactions up for growth and success while mitigating risks. We’re specifically looking for counsel with experience in leasing, management agreements, real estate brokerage, real estate regulatory compliance, purchase and sale contracts, and licensing. Reporting to the General Counsel, you will work cross-functionally with our Executive, Investments, Brokerage, Policy, and Retail teams to set and enforce company strategy regarding all licensed activity and own a wide range of regulatory and compliance matters relating to AvantStay’s real estate operations and brokerage activities. You will be individually responsible for setting up and maintaining corporate entity structures and real estate licenses across our growing national operations.

What you’ll do…

  • Draft, review, and manage contracts related to leases, vacation rental management agreements, independent agents, offers, listing agreements, referrals, buyer representation, and brokerage partnership agreements.
  • Develop, refine, and implement brokerage policies & procedures.
  • Support our Retail & Product teams in contract lifecycle system developments and data integrity.
  • Advise stakeholders on landlord-tenant issues and other matters pertaining to real property law
  • Ensure vacation rental contracts are appropriately assigned to licensed subsidiary operators.
  • Support our Investments team in developing a compliant acquisition process that mitigates risks to the company and our clients.
  • Oversee dispute escalations and litigation related to real estate transactions
  • Liaise with our local brokers on compliance and contractual matters regarding their local agents and regulatory bodies.
  • Partner with our Policy team to ensure short-term rental licenses are appropriately managed and taxes remitted accordingly.
  • Build and enforce training and licensing protocols for internal Retail team members supporting our vacation rental management business in states where appropriate.
  • Review licensure of M&A targets and manage integrating target brokerages and related intellectual property.
  • Ensure the company’s marketing materials adhere to all company policies and procedures while abiding by all state and federal Fair Housing and real estate laws.
  • Develop and nurture relationships with Departments of Real Estate and lead audits and investigations as they may occur.
  • Provide superior customer support to all of our brokers and support staff.

Requirements

What you’ll bring…

  • Active law license in at least one of our operating states.
  • Extensive knowledge of real estate laws, real property agreements, entity structuring, and regulatory compliance related to brokerages and short-term rentals.
  • A willingness to learn and stay abreast of new laws related to your vertical.
  • Minimum 3+ years of legal experience in real estate with an emphasis on leasing, purchase and sale transactions and/or property management.
  • Ability to work autonomously and project manage across a wide range of adjacent teams.
  • Strong business acumen and ability to set and manage competing priorities.
  • Excellent verbal and written communication skills.
  • Professional demeanor with strong attention to detail.
